ORDER

AND NOW, this _______________ day of ____________________, 2005, upon consideration of the testimony taken in open court and upon the motion of John Harris, pro se, it is hereby ORDERED:

Defendant, Wendy L. Flanders is found to be in contempt of the Order of Court dated September 20, 2004; and
As a result of this finding of contempt, Petitioner, John D. Harris is awarded make-up time in the amount of 48 hours (one weekend visit). Defendant, Wendy L. Flanders, shall forfeit her next regularly scheduled weekend visit and Defendant shall pay to Petitioner the sum of FIVE HUNDRED DOLLARS ($500) in fees to bring this petition and payable immediately.

PETITION FOR CONTEMPT

1. Petitioner is John D. Harris, Plaintiff in the above captioned case.

2. Respondent is Wendy L. Flanders, Defendant in the above captioned case.

3. The parties are the parents of a minor child, namely Bryna Elizabeth Flanders-Harris, born April 7, 1992, current age 12.

4. The custody hearing scheduled for December 8, 2004, was rescheduled for February 15, 2005.

5. On Friday, February 4, 2005, Defendant violated the current Custody Order by not providing the party’s daughter to the Defendant for his regularly scheduled weekend visitation beginning on the same day.

6. Defendant willfully refused to communicate an agreement with the Plaintiff that might have averted a missed visit.

7. Further, Defendant provided the child with permission to cancel the weekend visit despite ongoing negotiations between the child and the father (Plaintiff).

WHEREFORE, Petitioner requests this Honorable Court to enter an Order directing that Respondent, Wendy L. Flanders, be held in contempt for failing to comply with the Court Order, award Plaintiff make-up time, pay fees necessary to bring this petition, and to comply with all further Court Orders.
